NSW Maritime adopts USL Code 2008

NSW Maritime has adopted a new version of the Uniform Shipping Laws Code, known as USL Code 2008.  This came into force nationally on 1 October 2008.

USL Code 2008, like its predecessors, sets standards for the design, construction, equipment and crewing of commercial vessels.

While much of the code will be the same as the previous version, a number of important updates to the code have been made by incorporating parts of the new National Standard for Commercial Vessels.  Specifically the code picks up new standards for:

  • Structural fire protection;
  • Engineering;
  • Fuel tank construction;
  • Use of LPG fuel;
  • Medical equipment;
  • Safety equipment;
  • Fast craft; and
  • Electrical wiring.

The new standards picked up in the new code have been developed by the Commonwealth over the past 7 years in consultation with industry and the state and territory marine authorities.

A key aspect of the new code is its reference to performance-based outcomes, which the vessel owner or builder can meet by either a deemed-to-satisfy standard as prescribed or an ‘equivalent solution’ which is demonstrably equal to or better than the standard.

USL Code 2008 will apply to all new vessels, and those vessels undergoing initial survey or an upgrade in class.

Transitional arrangements will allow vessels, for which an application for design approval is lodged prior to 1 October 2008, to be built according to the existing USL Code provided that construction of the vessel commences before 1 October 2011.
